1. INTRODUCTION
1.1 These Terms and Conditions govern the sale, including registration, of Trend Affair products through the website www.trendaffair.pt.
1.2 The website www.trendaffair.pt is managed by the company Spring Revelation Lda, corporate body no. 514 773 987, headquartered at Rua Almeida Brandão N16, 1200-613, Lisboa Portugal.
1.3 For the purposes of these Terms and Conditions, the following definitions shall apply:
a) – “Trend Affair” – Products sold on the website www.trendffair.pt;
b) – “User” – Any natural person, not a merchant, who places an order through the website www.trendaffair.pt;
1.4 The use of the website www.trendaffair.pt and the purchase of Trend Affair products presupposes the knowledge, understanding and acceptance of these Terms and Conditions by the User.
2. REGISTER ON THE WEBSITE
2.1 To place an order, the User may previously register, filling in the fields included in the form on the website www.trendaffair.pt.
2.1.1 It is also possible to place your order without prior registration. However, by registering on the website your data and preferences will be saved to be more easily used in future purchases.
2.2 Upon completion of registration, the User has access to your personal account, where you can manage your account settings, your favorite items and your orders.
2.3 As soon as you access your personal account, the User is subject to these Terms and Conditions.
3. THE PRODUCTS Trend Affair
3.1 The website www.trendaffair.com is intended for all users who wish to purchase Trend Affair products from their home or place of work, 24 hours a day, 7 days a week.
3.2 Information on product characteristics can be found at www.trendaffair.pt.
3.3 Trend Affair reserves the right to modify, at any time, the information, offer of products, prices, promotions and commercial conditions, presented in the website www.trendaffair.pt.
4. MAKE ORDERS ON THE WEBSITE
4.1 To order at www.trendaffair.pt it is necessary that the User has an email account and that his / her browser is configured to accept cookies and pop-ups, which will allow the user to enjoy all the navigability conditions of the online store Trend Affair.
4.1.1 The User may proceed to the online purchase of products, for which it is necessary that:
a) Find the product (s) you wish to purchase;
b) Add the selected product (s) to the “Shopping Cart”;
c) Register the personal data of the User, which will be integrated into the Trend Affair database in accordance with the terms of the Privacy Policy, including “Delivery Address”, “Billing Address”, “Payment Method “, telephone number and tax identification number (NIF);
d) Review your order and confirm the order;
4.2 The User will receive an order confirmation email with details of the payment method that you have selected. After payment validation, you will receive a confirmation email.
4.3 Trend Affair will make available all the details of the purchase through the website www.trendaffair.pt, in its customer area.
4.4 Your order will be delivered by the logistics operator at the delivery address indicated in the purchase process and with the detailed invoice.
4.5 When sending the order form the User accepts the Terms and Conditions of purchase described in www.trendaffair.pt, as well as with the Privacy Policy.
4.6 Trend Affair reserves the right not to accept and cancel orders already confirmed in the following situations:
(a) the product is not available;
b) Payment is not made using any of the payment options available on the website www.trendaffair.pt;
c) The payment is not confirmed;
d) The billing information is not correct or verifiable;
e) The transfer for payment of the order was not received by us within 5 (five) days after the acceptance of your order;
f) There is an error in the price quotation;
g) It is not possible to deliver to the address provided by the User.
5. PRICES
5.1 The prices of products displayed on the website www.trendaffair.pt include Value Added (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the user.
5.2 The prices are all quoted in euros (€). Note that the change of country of delivery may have influence on the prices due to different transport costs. The customs costs related to the country of delivery of the order will be borne by the customer.
5.3 The prices of the products presented on the website are subject to change. Trend Affair reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.4 In case of an error in the price of the requested products, Trend Affair or the User may cancel the order until the order is dispatched.
5.5 The total price specified at checkout includes taxes of the country of origin (Portugal) and shipping costs.
5.6 The User must pay only the amount specified in the order confirmation.
6. METHODS OF PAYMENT
6.1 The User may make payment of his purchases through the Easypay payment management entity, through ATM or Credit Card Reference.
6.2 Trend Affair does not accept any payment methods other than those mentioned in the previous paragraph. The User should not attempt to pay by any other means that does not appear in the specified payment methods. If you do, we will not be liable for loss of payment or any other damages that may arise.
7. SHIPPING COSTS
7.1 Shipments to Portugal (Mainland) cost € 4.90. Shipments to the Islands have a cost of € 9.90.
7.2 Outside Europe, all orders will have an associated shipping cost, and may require the payment of customs costs, according to the country of delivery.
7.3 For orders above € 250, shipping costs are free to any destination in Europe.
8. DELIVERY
8.1 Trend Affair sends the product (s) ordered by the User, from Monday to Friday, from 9am to 7pm, except for holidays, and on the days and times used by the logistics company, to the delivery address indicated by the User.
8.2 Our delivery service does not include scheduling option, so delivery of the order will be made without prior contact by the carrier, being necessary to ensure that someone is in the delivery address.
8.3 Delivery times may differ depending on the brand that the User wants to purchase. However, Trend Affair’s ability to respond within the aforementioned deadlines is, however, dependent on the availability of the stock, and can not be assured during the promotion, balance and Christmas periods.
8.4 Trend Affair will inform the User of the unavailability of the product (s) ordered, as well as refund the amount paid, within a maximum period of 15 (fifteen) days from the knowledge of the unavailability.
8.5 In case of the unavailability of the carrier to deliver the products on the date indicated, the User will be contacted in order to be indicated another date of delivery.
8.6 At the time of delivery, the User must inspect the packaging for any damage. If you find that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, by email to devolucoes@trendaffair.pt and if you agree, Trend Affair will proceed to the return of the order, at no cost to the User. If you wish to cancel the order, you will be refunded the full amount paid.
8.7 If you do not receive your order within 90 (ninety) days from the payment date of the order, please send an email to devolucoes@trendaffair.pt informing us of what happened. At the end of this period, Trend Affair can not be held liable for lost order.
8.8 The delivery is considered done with the signature on the delivery receipt at the agreed upon address.
9. RIGHT TO RESOLVE FREE
9.1 The User may terminate his contract until 7 (seven) days after receiving the order, provided that:
(a) the product (s) have not been used;
b) The product (s) retain their original characteristics and labels intact;
c) The product (s) are complete. All the material that accompanies the orders has to be returned.
9.2 The User may exercise his right of free resolution by sending an unambiguous statement of termination of the contract, to the e-mail address devolucoes@trendaffair.pt.
9.3 The cost of returning the order in the exercise of the right of free resolution is borne by Trend Affair.
9.4 Upon receipt of the returned product, Trend Affair will review and confirm the condition of the order and, where applicable, refund within a maximum period of 14 (fourteen) days the amounts paid by the User in the order, using the same medium used for payment of the order.
9.5 If returned items show signs of use, Trend Affair reserves the right not to accept return and refuse reimbursement.
9.6 The right of free resolution shall not apply to the product (s) ordered have been made according to User’s specifications or manifestly personalized or in the case of products that are sealed and health or hygiene reasons when they are opened after delivery.
9.7 The User should note that if your return has been made for reasons other than the justified existence of defect or nonconformity of the ordered products, Trend Affair will not reimburse the shipping costs. Accordingly, Trend Affair will not reimburse any costs incurred in connection with the charges initially borne by the customer for the order.
9.8 Please note that these conditions are valid only for orders placed in Portugal. If your order has been placed outside Portugal, please contact us at devolucoes@trendaffair.pt.
10. CANCELLATIONS AND RETURNS
10.1 The User may cancel your order, as long as you request it through the email devolucoes@trendaffair.pt before sending it.
10.2 If the order has been received prior to shipment, we will refund the amounts paid by the User in the order, using the same means used to pay the order, within a maximum period of 14 (fourteen) days.
10.3 If the request has been received after the dispatch, the rules in the previous chapter regarding the right of free resolution shall apply.
10.4 It is not possible to cancel or exchange orders that have been made according to User’s specifications or manifestly personalized.
10.5 Trend Affair does not offer exchanges. The User may change his order to another available on the website, and will be responsible for all costs related to the exchange.
10.6 In the event that the ordered product is found to be defective or otherwise non-conforming, the User may choose:
a) repair the product;
b) replace the product;
c) resolve the contract.
10.7 As soon as the User discovers a defect or other nonconformity of the product, he / she must communicate to us through the email devolucoes@trendaffair.pt, sending supporting photographs.
10.8 As soon as we receive your email, we will contact you to resolve the problem in a consensual way.
10.9 In any of the options exercised by the User, at the expiration of 11.6, the respective costs will always be borne by Trend Affair.
11. QUALITY
Trend Affair does not sell second-hand, defective or substandard products on the market. The main features of each product shown at www.trendaffair.pt can be found on each product page.
Trend Affair will make every effort to make the colors of the products that appear on the website www.trendaffair.pt as accurate and real as possible. However, as computer monitors vary, we can not guarantee that your monitor is showing the exact colors.
12. WARRANTY AND SERVICES AFTER SALE
Trend Affair products benefit from the compliance guarantee provided by the legislation applicable to the sale of consumer goods.
13. DISCLAIMER AND LIMITATION OF LIABILITY
Trend Affair does not guarantee the uninterrupted operation of the website www.trendaffair.pt, or any of its features, and may be suspended for maintenance, repair or updates.
Trend Affair shall not be liable for any damages whatsoever arising directly or indirectly from force majeure situations that prevent Trend Affair in any way from complying with its obligations, including strikes, failures electricity, telecommunication services or any other services, fires, floods, impossibility to obtain products, materials or services, malfunctions, delays of suppliers or transporters and changes in legislation or administrative regulations.
Trend Affair is not responsible for any abusive use of the user’s access data to the website by third parties, as they are personal and non-transferable.
14. MODIFICATION OF TERMS AND CONDITIONS
Trend Affair reserves the right to change, at any time, these Terms and Conditions, taking into account the changes made and the users notified through the publication on the website www.trendaffair.pt of the modified Terms and Conditions.
15. TREATMENT OF PERSONAL DATA
We urge you to carefully read our Privacy Policy so that you may be aware of the rules and procedures adopted by Trend Affair regarding the handling of the data collected when you browse the website www.trendaffair.com and when you use the features offered by Trend Affair as well as security measures and confidentiality.
16. PROOF AND ARCHIVE
The computer records, maintained by Trend Affair in a safe condition, are considered as evidence of communications, orders and payments made between Trend Affair and the User.
17. APPLICABLE LAW
These Terms and Conditions and all emerging litigation related to them, including their validity, use of the website or any purchase thereof should be governed by Portuguese Law.
18. VALIDATION OF PROMOTIONS
18.1 The site offers are valid only for the time they are displayed on the site, unless otherwise communicated on the site. Trend Affair respects the offers established by the brands / designers and is not bound by any offer if there are errors or mistakes in spelling, prices or other information. Trend Affair reserves the right to cancel any purchase and sale made under such errors.
